1. Acceptance of terms

By accessing or using skillhorizontechnologies.in (the "Site") and our services, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site or services.

2. Services

Skill Horizon Technologies provides software development, design, marketing, and consulting services. Specific deliverables, scope, fees, and timelines are governed by a signed Statement of Work ("SOW"). In any conflict between these Terms and a signed SOW, the SOW prevails for that engagement.

3. Use of the Site

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Site or related systems
• Use bots, scrapers, or other automated means to access the Site beyond what is permitted by our robots.txt
• Interfere with the operation of the Site or its security features

4. Intellectual property

The Site, including its design, text, graphics, logo, and code (excluding client deliverables), is owned by Skill Horizon Technologies and protected by applicable IP laws. Our brand assets are made available under the terms set out on our Brand Kit page.

For client engagements: upon full payment, you receive full ownership of the deliverables explicitly listed in the SOW, with the exception of third-party libraries (which retain their original licenses) and any pre-existing Skill Horizon tooling we use. We retain the right to display the project in our portfolio unless an explicit NDA forbids it.

5. Payment terms

Unless otherwise stated in a signed SOW:

• Fixed-price projects: 50% upon SOW signing, 50% on completion
• Retainers: monthly in advance, invoiced on the 1st
• Net 7 payment terms; late payments incur 2% interest per month
• Work pauses if invoices are 14+ days overdue; resumed upon clearance

6. Warranties & disclaimers

We provide our services with reasonable skill and care. For delivered code and design, we offer a 30-day warranty to fix bugs that demonstrably stem from our work at no extra cost. Beyond that warranty period, ongoing support is available via a separate maintenance SOW.

The Site and any content on it is provided "AS IS" without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted or error-free.

7. Limitation of liability

To the maximum extent permitted by law, Skill Horizon Technologies, its directors, employees, and contractors will not be liable for any indirect, incidental, special, or consequential damages (including loss of profit, revenue, data, or business opportunities) arising out of or in connection with these Terms or our services.

Our total cumulative liability for any claim under a specific engagement is capped at the fees you have paid us under that engagement in the preceding 6 months.

8. Confidentiality

Each party will treat any information marked confidential, or that a reasonable person would consider confidential, as such. Confidentiality obligations survive termination of the engagement for 3 years. We are happy to sign your standard NDA in addition to or in place of this clause.

9. Termination

Either party may terminate an engagement with 14 days' written notice, except in case of material breach (e.g., non-payment, gross misconduct), in which case immediate termination is available. On termination: we deliver all work-in-progress, you pay for work completed up to the termination date.

10. Governing law & dispute resolution

These Terms are governed by the laws of India. Any dispute will first be attempted to be resolved by good-faith negotiation. If unresolved within 30 days, the matter will be referred to arbitration in Andhra Pradesh, India under the Indian Arbitration and Conciliation Act, 1996. For clients outside India, alternative jurisdictions may be agreed in writing in the SOW.

11. Changes to terms

We may update these Terms from time to time. Material changes will be posted here and dated. Continued use of the Site or services after a material change constitutes acceptance.
